JND Transport and Logistics Pty Ltd (ABN 79 702 805 589) is an Australian company based in Melbourne VIC, providing transport, freight and logistics services including general freight cartage, line-haul distribution, palletised freight movement and related logistics support across Australia.

3. Quotes and Bookings

All quotes provided by us are estimates based on the information supplied at the time of the request and are valid for the period stated on the quote, unless otherwise agreed in writing. A booking is confirmed only when we accept your instruction in writing. Final charges may vary where the actual weight, dimensions, volume, access conditions or service requirements differ from the details originally provided.

4. Customer Obligations

You agree to:

• Provide accurate and complete information about the freight, including its nature, weight, dimensions and any special handling requirements;
• Ensure goods are appropriately packaged, labelled and prepared for transport;
• Ensure safe and lawful access at both pickup and delivery locations, including suitable loading and unloading facilities where applicable;
• Comply with all applicable laws and regulations relating to the goods, including any dangerous goods requirements;
• Not tender goods that are illegal, hazardous or otherwise prohibited without prior written disclosure and agreement.

5. Payment Terms

Unless otherwise agreed in writing, payment is due within the period stated on our invoice. We may require a deposit or prepayment for certain services. Late payments may attract administrative fees and we reserve the right to withhold further services, or hold freight, until outstanding amounts are paid.

6. Carriage of Goods and Liability

Our carriage of goods is subject to the terms of any consignment note or transport documentation issued for the movement. Where we act as a freight and logistics service provider, we may engage third-party carriers or subcontractors to perform part or all of the carriage on our behalf.

Our liability for loss of or damage to goods is subject to any applicable limitations under the Carriage of Goods by Land Act or equivalent state legislation, and to the terms of any transit insurance arranged in connection with your consignment. You should declare the value of your goods where insurance cover is requested.

We are not liable for loss or damage arising from inadequate packing, incorrect or insufficient labelling, defects in the goods themselves, events outside our reasonable control, or your breach of these terms.

7. Delivery Timeframes

Any delivery timeframes provided are estimates only and are not guaranteed. While we work diligently to meet agreed schedules, transport and logistics services may be affected by factors beyond our control, including traffic, weather, road conditions, border restrictions and mechanical issues. We will notify you promptly of any significant delay where practicable.

8. Australian Consumer Law

Nothing in these Terms of Service excludes, restricts or modifies any right, remedy or guarantee conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be lawfully excluded or modified. Where services supplied to you are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to comply with a consumer guarantee may, where permitted by law, be limited to the resupply of the services or the cost of having the services supplied again.

9. Force Majeure

We are not liable for any failure or delay in performing our obligations where that failure or delay is caused by events beyond our reasonable control, including natural disasters, industrial action, government restrictions, pandemics, extreme weather or other force majeure events.
